How a Crosswalk Failure-to-Yield Case Gets Built

The Problem

A pedestrian crossing in a marked crosswalk with a walk signal is struck by a left-turning driver who tells police the sun was in his eyes. The insurer argues the pedestrian was at fault for crossing too quickly.

The firm pulls signal timing from the city traffic department, traffic-camera footage, the driver's phone records, and statements from other pedestrians at the intersection. Sun-angle data is checked against scene photographs to evaluate the visibility claim.

Do pedestrians always have the right of way? +
Not always, but Florida statute gives pedestrians strong protections in marked and unmarked crosswalks at intersections. Drivers are required to yield to pedestrians lawfully within those crosswalks, and the duty to look out for pedestrians does not disappear simply because a person is crossing where the paint has faded or where a marked crosswalk does not exist. Insurers often misstate this rule in the first call to the injured pedestrian.
Does PIP cover me if I was on foot? +
Florida PIP can apply to a pedestrian struck by a motor vehicle in many cases, depending on the pedestrian's own auto policy and the household's coverage. Even pedestrians who do not own a vehicle often have PIP available through a household auto policy and may have MedPay coverage as well. Identifying every layer early is one of the first jobs we do at intake.
What if the driver fled the scene? +
Your own or a household member's uninsured-motorist coverage often becomes the primary recovery source. We move quickly to identify every applicable policy.
Will I be blamed if I was not in a crosswalk? +
Crossing outside a crosswalk does not automatically bar recovery in Florida.
