Am I required to ride in the bike lane? +
Florida law allows cyclists to take the full lane when the lane is too narrow for a bicycle and a motor vehicle to share safely, when the cyclist is preparing to make a left turn, or when avoiding a hazard or obstruction. Adjusters who insist you should have been in the bike lane often misstate the rule, and the statute's text routinely defeats the 'you should have been further right' argument.
Does PIP apply if I was on a bike? +
Florida PIP can apply to a cyclist struck by a motor vehicle in many situations, depending on the cyclist's own auto policy and the household's coverage. Even cyclists who do not own a car often have PIP available through a household auto policy. We map every available layer at intake.
What if the driver fled the scene? +
Your own uninsured-motorist coverage often becomes the primary recovery source after a hit-and-run, and household auto policies belonging to a resident relative can also extend coverage to the cyclist. We move quickly to identify every applicable policy, secure scene witnesses while their memories are fresh, and request preservation of any nearby camera footage that may have captured the fleeing vehicle's plate or distinguishing features.
Will my recovery be reduced if I wasn't wearing a helmet? +
Florida law does not require adult cyclists to wear helmets. Helmet absence can become an argument for the defense but does not bar recovery.
How long do I have to file? +
Florida's statute of limitations for most negligence-based injury claims is two years for accidents on or after 2023. Earlier consultation is always safer.
