Florida law allows riders 21 and over with the required insurance to ride without a helmet. While the lack of a helmet can become an argument for the defense, it does not bar recovery and is one of several factors we anticipate and address.

Does PIP apply to motorcycle accidents? +
Florida's standard PIP framework does not automatically apply to motorcycles in the way it applies to passenger vehicles. Coverage for motorcycle injuries depends heavily on the rider's specific motorcycle policy, any health insurance or MedPay coverage in place, and whether the at-fault driver's vehicle has bodily-injury liability or UM coverage that reaches the rider. Mapping all of these layers at intake is essential.
How is my recovery affected if I was partially at fault? +
Florida follows modified comparative negligence. If you are more than 50% at fault you generally cannot recover; below that, your recovery is reduced by your share of fault.
How long do I have to file? +
